So as a new yorker & someone involved with affiliate marketing, i have been following the “amazon tax law” (as NY was dumb enough to name it…).

Until now i heard, that affiliates are basically backing down from the law and terminating their relationships with NY based affiliates. There are some notable exceptions - amazon has chosen to NY to court and try to get this “amazon tax law” thrown out, i hear that overstock is suing as well.

Also interesting, is that amazon did not terminate their relationship with its NY based affiliates - but rather started charging tax to orders shipped to NY (which sucks for me - bec i am (was?) a hardcore amazon customer. My wife would ask me to go to the store and get diapers - i jumped over to amazon.com and got them shipped (free of charge) 2-day delivery,  with no tax. )

But today, i get an email from a top 100 e-tailer with a couple of physical store locations in the US (that has been around for almost 100 years! founded in 1910!) Blair.com. They decided not to terminate our affiliate relationship - but rather asked that i fill out and sign the attached addendum to the Terms & Conditions - so we can continue working together.

Terms & Conditions - Addendum of 5/23/2008

These Special Terms and Conditions (this “Addendum”), made by Blair, and entered into by you, the Publisher (“You” or “Publisher”), acts as an addendum to any current Master Service Agreement, Publisher Service Agreement, and/or Terms & Conditions currently in effect and entered into between Blair and You, the publisher.

You, the Publisher, agree to the following terms:

Promotional Restrictions

You, the publisher, are solely responsible for compliance to all of the following:

1. You, the publisher, agree to only advertise and/or promote Blair through the digital medium of the Internet, and through no other medium.

2. You agree not to distribute any Blair advertising or promotional materials of a physical nature, regardless of design or reason.

Liability

You, the publisher, agree to be solely liable for all damages (monetary & non-monetary) incurred through non-compliance to the promotional restrictions listed above.

This is great news that an affiliate found a work around, or at least is willing to try to hack around the “amazon tax law” that is set to take food off the plate of many many NY-based affiliate marketers.
